Your ability to recover from an insurance company is actually limited by the amount of coverage that the person or business entity liable for your accident has chosen to purchase. For example, if you have suffered a serious brain or spine injury in a car accident, your medical bills alone could run to hundreds of thousands of dollars. Yet if the person who caused the accident only holds $100,000 in coverage, this is probably going to be the insurance company’s max offer.

What If You Need More Compensation?

There are three possible ways to secure additional compensation beyond the insurance policy limit:

Check for Umbrella Policies: Companies often have umbrella insurance policies that offer them additional protection above and beyond whatever specific policies they may have for insuring their premises, their vehicles, etc. Occasionally private individuals will also have umbrella policies. It is always worth checking out because if an umbrella policy exists you would then be able to make a claim under it for additional damages not covered by the first policy.

Target Multiple Defendants: In car accident cases, there are often multiple parties at fault. This provides increased protection for injured individuals because you then have more insurance policies to file claims under.

Collect from the Defendant Directly: You can file a personal injury lawsuit against the person or business entity responsible for you injuries. If you win the lawsuit, the court will order the defendant to pay you out of their own pocket for whatever additional damages have been awarded to you in the judgment. This option works well against corporate defendants or very wealthy individuals, but if the defendant is not a person of means it may be very difficult to ever get your money from them.
