Man Receives $26.55 Million for Truck Accident Injuries

Earlier this month, Pennsylvania landscaper David Williams secured a personal injury settlement worth $26.55 million. Though a quarter of a billion dollars may seem like a huge amount, Williams’ injuries are equally huge and the circumstances of his truck accident easily justify this figure—or even more.

The accident took place near Philadelphia in November of 2011. At the time, Williams was driving a truck that belonged to his employer. He suddenly lost control as the truck swerved off the road and rolled over. Williams was ejected from the vehicle and suffered a fractured spinal cord.

After several surgeries, the 32-year-old father of three is now confined to wheelchair. He has no feeling below his chest and limited use of his hands and arms. He requires constant nursing assistance.

The true tragedy of this accident is that it should have been prevented. Indeed, it could easily have been prevented had any of the defendants exhibited a bare minimum of care in maintaining Williams’ company truck.

The root cause of the truck accident was a bald tire. Everyone knew about it—Williams, his employer, and the company responsible for servicing his employer’s fleet. In fact, company technicians remarked on the bald tire the very day of the accident. It failed their inspection but they sent Williams out to work anyway.

After the accident, Williams targeted four different companies in a truck accident injury lawsuit. He alleged that his employer, their parent company, the fleet maintenance company, and the auto repair company that worked on the truck, had all exhibited gross indifference to his safety and were therefore liable for his injuries.

Obviously not willing to risk facing Williams in court, all four parties settled. His employer and their parent company will pay a total of $16.75 million, while the fleet maintenance company will pay $9.5 million and the auto repair company will pay $300,000.
