Learn About Your Legal Options if You Suffered Injury While Working as a Food Deliverer

If you deliver food for Instacart, DoorDash, UberEats, or any other comparable company, you might be wondering what happens if you are hurt while doing so. Workers’ compensation would not cover you because you are not a legal employee of the firm. Does this mean that all injuries must be paid for out of pocket or by your own health insurance?

Every business has its own set of policies

There are a variety of firms for which you might work in this position, and each one has its own set of procedures for dealing with these issues. If you have particular questions about a corporation, you may contact them directly or schedule an appointment with an attorney. Today, though, we will take a look at Instacart to see what its policies are. They are one of the most well-known grocery delivery services.

Instacart’s contract specifies that their customers are not employees

Anyone who shops for Instacart must sign an independent contractor agreement stating that they are self-employed service providers. Employee benefits, such as workers’ compensation and disability, are not available to them. The agreement also states that workers are responsible for obtaining their own workers’ compensation or disability insurance if they so want.

Shopper Injury Protection Insurance is available via Instacart

Instacart began offering harm protection insurance as a service to their customers in 2019. This is part of their “Shopper Perks Program,” as they call it. This is a complete policy that covers up to one million dollars in medical expenditures, disability, and survivors’ benefits for all full-service shoppers.

While this may appear to be comparable to workers’ compensation, it is not the same. Workers’ compensation is a no-fault insurance policy that does not require the worker to establish that their injury was caused by someone else’s negligence. Damage protection insurance operates in the same way as other insurance policies: the consumer must submit a policy, and the insurance company will determine if the injury is covered and how much should be paid out.
