Car Accidents Involving Uber Drivers: What is Your Responsibility

If you’ve been involved in an accident involving an Uber driver, whether you were a passenger or they were driving the vehicle you collided with, there are certain steps you need to take. As with any accident, you’ll need to ensure that everyone gets medical attention and you’ll need to document the crash, but there are additional factors you may need to consider.

Take pictures and document the accident no matter what the Uber driver says

Most people know that if there is a dispute about who’s at fault for an accident, then they need to take pictures, video statements from drivers and / or passengers, etc. However, too often at Law Offices of Fernando D. Vargas we’ve seen our clients not get this documentation for a simple reason: The driver admitted fault at the scene of the accident. Their admission means nothing if you aren’t able to document it.

At a minimum you want to document:

  • The names, phone numbers, and addresses of all driver’s involved in the accident.
  • Each vehicles’ insurance information.
  • Contact information of witnesses at the scene.

You should also get pictures and / or videos of the scene and the vehicles if possible. Remember that it is very common for the at-fault driver to change their story once they talk to their insurance company or get their own auto accident attorney. Even when liability seems clear, be sure you’re getting the documentation you need to pack it up.

What does Uber have to say about accidents involving their drivers?

Uber claims that each of their drivers is required to submit to a background check and to prove that they’re competent drivers. If those drivers are in an accident, Uber will likely fire them and not allow them to continue driving for them. Uber claims that this is incentive enough to keep drivers driving safely.

When is it time to hire an attorney?

In general, whether you were involved in a car accident with an Uber driver or any other driver, the more serious injuries are and the more serious the property damage is, the more likely it is that you’ll need an attorney. For example, someone with a sprained ankle and less than $500 in damage to their vehicle may not hire an attorney, while someone with a leg fracture and a totaled car may.
