I was in an accident in an Uber — can I sue?

If you are injured in an accident while riding in an Uber, you can file a lawsuit.  The question of who will pay for your damages will depend on who was responsible for the accident.  If another driver caused the crash — not your Uber driver — then that driver’s insurance will likely cover your losses.  If your Uber driver was responsible for the accident, then Uber will pay for your damages.

In California, once an Uber driver has accepted a passenger and is driving them to their destination, the driver is covered by Uber’s insurance.  California requires Uber to provide primary insurance with a limit of $1 million, plus uninsured and underinsured motorist coverage with a $1 million limit.  This means that even if another driver was responsible for the accident, but they either don’t have insurance or don’t have enough to cover your losses, you’ll be covered under Uber’s uninsured or underinsured motorist coverage.  Uber’s insurance coverage starts when you enter the vehicle and ends when you leave it.
