Can you sue a vape company if the vaporizer blows up?

Yes.  If you are using a vaporizer and it blows up, causing injury, then the vape company will likely be responsible for your damages.  However, if you did something to the vaporizer to cause it to explode, such as tampering with the battery, then you may not be able to recover because you were not using it in the intended way.

A vaporizer blowing up is an example of a product liability lawsuit.  In California, these cases are handled on a strict liability basis, which means that you will not have to prove that the vape did something wrong to recover for your damages — as long as you were using it in the way you were supposed to use it.  The answer to question 2 explains more about California’s product liability law.
