The First Three Steps to Take if You Are Considering Suing for Damages

If you or a loved one has been hurt then calling a personal injury attorney is not likely the first thing that comes to mind. You want to ensure that you and your loved one are safe. However, after everyone is treated for their injuries and the dust has settled, it may be that you want to file a lawsuit.

At Law Offices of Fernando D. Vargas we hope you will carefully consider the three steps to take if you are considering filing for damages in the future. Once you’re reading to get the process started, or if you want to get a free legal consultation, contact us at 909-982-0707 right away.

  1. Take notes about exactly what happened

  2. One of the biggest mistakes you can make is to assume that you will always remember exactly what happened. The truth is that even the worst memories fade over time. In fact, sometimes the painful memories are the first to dull. Take notes on the accident or injury so that you can refer to them and provide them to your personal injury attorney later on if necessary.

Your notes should be happened not just during the accident but before it and after it. You should write down everything you can remember, including who was there, their contact information, where the accident took place, what the weather was like – literally everything you can think of.

  3. Take pictures

  4. It is often the case with accident cases that there is a lack of physical evidence. For example, if you were injured in a slip and fall accident you cannot take an entire floor out of a building to present it as evidence. Instead, photos can be helpful. We suggest either taking pictures while the scene is still the same, or recreating the scene as it was before, during, and after the accident. This is something Law Offices of Fernando D. Vargas can handle for you and we can even hire accident a reconstructionist if necessary.

  5. Get a police report

  6. If the police were involved in the injury or accident then they should have filed a police report. If they did, then you should get a copy of it. Depending on the circumstances, this report may or may not be admissible during a lawsuit. However, it may be useful as a negotiating tactic to encourage the defendant and / or their insurance company to provide a reasonable settlement. At a minimum, the police report will likely contain contact information you need.
