Property Owners Have a Legal Duty to Be Aware of Dangers on Their Property

Any business owner or non-profit owner in the state of California can have dangerous conditions on their property without even knowing it. One recent study showed that most owners of property and property managers aren’t aware of some of the most common slip and fall risk areas in their properties. The survey also found that some ways in which they address these dangers, when they’re even aware of them, can make the issues worse.

When you legally travel on to the property of another person or entity, you have a right to assume that the property is reasonably safe. This doesn’t mean that any injury you suffer on their property is necessarily their fault, but it does mean that if you slip and fall or are otherwise injured as a result of poor conditions on a property, and the property owner did or should have known about it, then you may have grounds for a premises liability lawsuit.

If this describes an injury you’ve been through then we encourage you to call Law Offices of Fernando D. Vargas at 909-982-0707. We are prepared to offer you a free legal consultation so that you can better understand your legal rights. You may have grounds for a lawsuit. We can let you know.

You may be in danger of a slip and fall accident at work

According to the Bureau of Labor Statistics, slip and fall accidents are the most common type of on-the-job injury. There’s no question that if a business owner doesn’t deal with slippery areas, that both their customers and their employees are at risk. That said, a survey by a national company showed that companies often don’t understand just how many risks there are on their own property.

One example is a study in which about half of those who responded said they had three or fewer of the risk areas for falls. When the properties were actually studied, it showed that they all had at least ten risk areas. As you can see, the owner of a property is often not good at determining danger spots on their property.

Some common solutions can make the problems worse

One of the most common ways to address the issue of slippery floors is by using rubber-backed mats. While they’re supposedly designed to offer traction for employees and customers, they can actually make the floors more dangerous. About 15% of those who responded to a survey said that when these surfaces wrinkled, they because a huge risk for tripping and falling. This is partially due to the fact that property owners put the mats down but don’t check them regularly to ensure they’re being used safely.
