Ask an Attorney: Is Video Evidence a Smart Idea After Being Involved in an Accident?

So you’ve been involved in an accident that wasn’t your fault and you’re wondering how to document it. Is it a good idea to take video evidence? At Law Offices of Fernando D. Vargas we get this question a lot. Victims of accidents want proof of their claims but they also don’t want to create evidence that the defendant could use against them. Our opinion is fairly simple: More evidence is almost always better.

Document the person who was at fault

In many cases, an accident is just that: An accident. No one is to blame. However, in many other cases, someone was negligent. Whether a big rig driver fell asleep at the wheel or a property owner caused a slip and fall accident by not taking care of their property, if someone was negligent or responsible for your injuries then you may have a case.

Video evidence could go a long way toward proving they were at fault. While police will get witness statements, nothing is quite as damning as video of the events themselves. For example, if you did slip and fall on someone’s property, immediately take a video of the conditions that led to your fall. If you were in a car accident caused by a semi swerving into your lane, immediately take video evidence (if you’re able to – always get medical help if it’s an emergency) of where the vehicles ended up after the crash.

Take video of your injuries

In some cases, it can be quite a hassle to prove to an insurance company that you are really injured. Remember that insurance companies are not in the business of helping you when you need it – they’re in the business of making money. The less they pay to you, the more money they make. It’s true that some injuries are beyond question – like fractures – but others can be hard to prove.

For example, if you have a broken rib or another type of injury that makes it difficult to complete daily tasks, take a video of yourself trying to do normal things around the house. This can be very helpful if your case ends up at trial.
